These terms are an agreement between you and mSalon ("mSalon", "we", "us") for the use of the mSalon website, business app, staff login and client app (together, the "service"). Please read them carefully.
1. Accepting these terms
By creating an account or using the service, you agree to these terms and to our Privacy Policy. If you use mSalon on behalf of a salon or company, you confirm that you are authorised to accept these terms for it, and "you" means that business. You must be at least 18 years old to create an account.
2. The service
mSalon is cloud software for running a salon: appointments, billing and point of sale, memberships and packages, client and lead management, messaging, staff and attendance, inventory, gift cards and loyalty, and reports. The features available to you depend on your plan, as described on our pricing page.
3. Your account
- Give accurate information when you sign up and keep it up to date.
- Keep your password and staff logins secure. You are responsible for everything done through your account, including by staff you give access to.
- Tell us promptly if you believe your account has been accessed without permission.
4. Free trial
New accounts may start with a 14-day free trial. No payment details are needed for the trial. Trial usage limits are shown on the pricing page. When the trial ends, you need to choose a paid plan to keep using the service.
5. Plans, billing & renewal
- Plans are billed in advance for the period you choose (monthly or yearly). Prices are in Indian rupees and GST is added as applicable.
- Each plan has limits — such as the number of clients, staff and branches — and an allowance of message credits.
- You can upgrade or downgrade from your dashboard. Upgrades apply immediately.
- If you do not renew, your account enters a grace period and then access is paused until you renew. Your data is kept as described under Your data.
- We may change prices for future billing periods. We will tell you in advance; changes never apply to a period you have already paid for.
6. Cancellation & refunds
You can stop renewing at any time; your plan stays active until the end of the period you have paid for. Fees already paid are non-refundable, except where the law requires otherwise. Message credits that have been used cannot be refunded.
7. Message credits
SMS and WhatsApp-related features use message credits. Credits included with your plan, and any you buy as top-ups from your wallet, are used as messages are sent. Delivery depends on telecom operators and carriers outside our control, so we cannot guarantee that every message is delivered.
8. Your data
- You own the data you put into mSalon, including your clients' and staff's information. You give us permission to store and process it only to provide and improve the service and as described in our Privacy Policy.
- You can export your client list at any time while your account is active.
- If your account is closed or not renewed, we keep your data for up to 90 days so you can renew or export it, and then delete it, except records we must keep by law.
9. Your responsibilities
Because you decide what information to collect about your clients and staff, you are responsible for:
- Telling them how you use their data and getting any consent the law requires — including before enrolling anyone in face recognition or biometric attendance, and before sending them promotional messages.
- Following the rules that apply to commercial SMS and messaging in India, including TRAI's regulations on commercial communications.
- Keeping your invoices, tax settings and GST details correct. mSalon calculates figures from the settings you choose but does not give tax or legal advice.
10. Acceptable use
You agree not to:
- Use the service for anything unlawful, or to send spam or messages to people who have not agreed to receive them.
- Upload content that is harmful, infringing, or that you do not have the right to use.
- Try to break, overload, reverse-engineer or gain unauthorised access to the service or other customers' data.
- Resell or share access to the service outside your own business without our written permission.
11. Availability & changes
We work to keep mSalon available and reliable, but it may occasionally be unavailable for maintenance, updates or reasons beyond our control. We regularly improve the service and may add, change or remove features; if we remove a significant feature you are paying for, we will give notice.
12. Our intellectual property
The mSalon software, apps, website, name and logo belong to us or our licensors. We give you a limited, non-exclusive, non-transferable right to use the service for your business while your account is in good standing. Feedback you give us may be used to improve the service without any obligation to you.
13. Suspension & termination
You may stop using the service at any time. We may suspend or close an account that breaks these terms, that puts the service or other users at risk, or where the law requires it. Where reasonable, we will warn you first and give you a chance to fix the problem and to export your data.
14. Disclaimers & liability
- The service is provided "as is" and "as available". We do not promise that it will be uninterrupted or error-free, or that it will meet every requirement of your business.
- To the extent the law allows, we are not liable for indirect or consequential losses such as lost profits, lost revenue or lost data, and our total liability for any claim is limited to the fees you paid us in the 12 months before the claim arose.
- Nothing in these terms limits liability that cannot be limited by law.
15. Governing law
These terms are governed by the laws of India. The courts having jurisdiction over our registered office have exclusive jurisdiction over any dispute. Before going to court, both sides agree to try to resolve the dispute in good faith by contacting each other.
16. Contact
